Mariah Carey has been sued for the second time over her song All I Want for Christmas is You.

Songwriter Vince Vance, real name Andy Stone, filed a copyright complaint in Los Angeles federal court on Wednesday claiming that the singer stole the Christmas track from his 1989 song of the same name.

"Carey has without licensing, palmed off these works with her incredulous origin story, as if those works were her own," lawyers for Vance wrote in the filing, reports Billboard. "Her hubris knowing no bounds, even her co-credited songwriter doesn't believe the story she has spun. This is simply a case of actionable infringement."

Vance had previously filed for copyright against the singer, but filed again on Wednesday after hiring a new legal team including Gerard P. Fox, who represented two songwriters who accused Taylor Swift of stealing their lyrics to create her song Shake It Off.

"The phrase 'all I want for Christmas is you' may seem like a common parlance today, in 1988 it was, in context, distinctive," the filing continued. "Moreover, the combination of the specific chord progression in the melody paired with the verbatim hook was a greater than 50% clone of Vance's original work, in both lyric choice and chord expressions."

Released in 1994, Carey's All I Want For Christmas Is You has topped the Billboard Hot 100 chart during each of the past four holiday seasons.
