Ice Spice is being sued for alleged copyright infringement over her 2023 song In Ha Mood.
Rapper/songwriter Duval 'D.Chamberz' Chamberlain and sound engineer/producer Kenley 'Kass the Producer' Carmenate have filed a lawsuit against Ice Spice, real name Isis Gaston, in the Eastern District of New York.
In the filing, obtained by TMZ and Rolling Stone, the musicians claimed that Spice and her producer Riot copied the name, beat, lyrics, hook and rhythmic structure of their 2022 song, In That Mood, without asking for permission or giving them credit.
"The similarities between In Ha Mood and In That Mood - including the key phrase used in the chorus and repeated in a substantially similar manner numerous times throughout both songs - are such that it is simply not reasonable to believe that In Ha Mood could have been created without having heard In That Mood first," the filing reads. "(The songs) are so strikingly similar that they cannot be purely coincidental."
The musicians claimed that Riot heard their song on the radio and both Spice and Riot saw them perform the track in New York.
"Upon information and belief, Ice Spice, Riot, and/or members of their creative teams were present for certain public performances of In That Mood during the relevant time period," they allege.
Chamberlain and Carmenate are seeking damages and at least half of the song's publishing.
The 24-year-old rapper has yet to respond to the lawsuit.
